If someone is present in the United States without permission for more than 6 months and then leaves the United States, the person is ineligible to apply for green cards for 3 years unless they qualify for a waiver. If someone is present in the United States without permission for more than one year and then leaves the United States, they will not be eligible to apply for green cards for 10 years unless they qualify for a waiver. In the past, those 3 and 10 years were required to be served outside the United States. Now, USCIS policy is that it does not matter where the person is located or whether they returned to the United States to complete that time<\/span><\/span><\/p>\n<p><span dir=\"auto\" style=\"vertical-align: inherit;\"><span dir=\"auto\" style=\"vertical-align: inherit;\">The group of people the change really helps are those who remained in the United States after a visitor visa expired in the past, left the United States, and then returned with a visitor visa or laser visa (\u201cBorder Crosser Card\u201d). Now, they can apply for U.S. permanent residence without a waiver if they have a relative who can apply for them.<\/span><\/span><\/p>\n<p><span dir=\"auto\" style=\"vertical-align: inherit;\"><span dir=\"auto\" style=\"vertical-align: inherit;\">The change does not fix all presence without permission issues. The change does not fix other presence issues related to entering the United States without inspection or without papers.
