The most common way involves three steps: a Labor Certification (PERM), an I-140 petition, and either an application for adjustment of status or an application for an immigrant visa at a U. S. consulate abroad. The entire permanent residence process can be lengthy, and it is quite daunting. At Vrapi Weeks, we take care of every step of the process so that owners and managers can retain valuable employees and focus on running the organization, not worrying about immigration barriers. Process The PERM process is intended to ensure that employers do not seek to employ a foreign national when qualified U. S. workers are ready, willing, able, and available to fill the position. This requires the employer to advertise the position in a variety of venues and properly document the recruitment process. This is a very onerous and unforgiving process. The I-140 petition is the visa petition the employer files to give the foreign national immigrant status. While the I-140 petition is commonly based on the PERM Labor Certification, there are other types of I-140 petitions, such as National Interest Waivers and petitions for foreign nationals of extraordinary ability, which do not require a labor certification. Learn who is affected, exceptions, and what remains unclear about the rule. - Published: 2025-09-22 - Modified: 2025-11-01 - URL: https://vrapiweeks.com/the-h-1b-100000-fee/ Last Updated October 20, 2025 On September 19, 2025, President Trump issued a Proclamation requiring an additional $100,000 fee for certain H-1B petitions effective on September 21, 2025 (Sunday). While the Proclamation is vague and the guidance issued early on (White House FAQ, USCIS memo, USCIS FAQ, CBP memo) left a lot of unanswered questions, USCIS recently provided an update of what circumstances will trigger the $100,000 fee. This blog will be updated as new information comes to light so please make sure and revisit it. Who Is Affected? The $100,000 fee will apply only to new petitions filed on or after September 21, 2025 when the beneficiary does not already have a currently valid H-1B visa stamp and: The beneficiary is outside the U. S. ; The beneficiary is inside the U. S. , but does not qualify for a change or extension of status from within the U. S. (i. e. violated status or status has expired); The beneficiary is inside the U. S. , but the petition does not request an extension, amendment, or change of status, and instead it requests consular, port of entry, or pre-flight notification; The beneficiary is inside the U. S. , but departs while the petition for a change of status is pending. Who Is NOT Affected? This new fee does not apply to: Petitions filed or approved prior to September 21, 2025; Those who have an H-1B visa issued to them already before September 21, 2025 that is currently valid; Petitions... --- > At Vrapi Weeks, our Albuquerque immigration attorney offers insight into who qualifies as immediate family for immigration and how their status impacts your application process. - Published: 2025-05-19 - Modified: 2025-11-01 - URL: https://vrapiweeks.com/who-is-considered-immediate-family-for-immigration/ At Vrapi Weeks, we break down immigration barriers so families can stay united and individuals can pursue their goals without fear. With decades of combined experience, our team has helped countless clients understand complex legal processes, including family-based immigration. Today, we're tackling a common question many people have when considering their options for bringing loved ones to the United States—"Who is considered immediate family under immigration law? " Understanding Immediate Family for Immigration Purposes When it comes to U. S. immigration law, "immediate family" has a very specific meaning. This term is crucial in family-based immigration, as it determines eligibility for certain visas and green cards. Immediate relatives are given a higher priority in the immigration process and are not subject to yearly numerical limits for visas, which means they have a smoother and often quicker path to joining or staying with their family in the U. S. Who Qualifies as Immediate Family Members? Under current U. S. immigration laws, immediate family members eligible for certain immigration benefits include: Spouses of U. S. Citizens - If you are married to a U. S. citizen, you are considered an immediate relative. This includes legally married same-sex or opposite-sex partners. Unmarried Children Under 21 of U. S. Citizens - Children qualify as immediate relatives if they are under 21 years old and unmarried. It's important to note that stepchildren can also qualify as immediate relatives if the parent married their stepparent before the child turned 18. Parents of U. S. Citizens -... --- > All non-citizens must notify USCIS of address changes within 10 days. The process can feel overwhelming at first, but understanding your options and following a clear plan can make it much more manageable. Below, we'll take you through the main pathways, common challenges, and practical advice to help you achieve permanent residency. Common Pathways to a Green Card The path you choose depends largely on your individual situation, including your work visa type, job, and family circumstances. Here are the two most common routes: 1. Employer Sponsorship - This is one of the most straightforward ways to transition from a work visa to a green card. If your current employer is willing to sponsor you, it typically involves three main steps: PERM Labor Certification: Your employer must prove to the Department of Labor that no qualified U. S. worker is available to fill your position and that hiring you will not negatively impact wages for U. S. workers. Immigrant Petition (Form I-140): Once the labor certification is approved, your employer files an I-140 petition to classify you as eligible for an employment-based green card. Green Card Application: After the I-140 is approved and your "priority date" becomes current (based on visa availability), you can apply for adjustment of status if you're in the U. S. or consular processing if you're abroad. 2. Family-Based Petitions - Sometimes, your family connections might make this process quicker... It's complicated, full of deadlines, and, at times, seemingly endless paperwork. But here's the good news—you don't have to go it alone. Partnering with an experienced immigration lawyer can make the entire process faster, smoother, and far less overwhelming. At Vrapi Weeks, we have helped countless clients navigate immigration law and successfully achieve their immigration goals. In this blog, we'll discuss why working with an immigration lawyer is essential and how it can expedite your case. Legal Guidance Saves You Time and Headaches One of the biggest challenges in immigration is not just knowing what's needed but when it's needed and how to ensure every detail is correct. The forms, evidence, and timing all have to align perfectly, or your case might face serious delays—or even denials. This is where an experienced immigration lawyer makes a world of difference. We're not just familiar with the system; we're seasoned in it. Avoiding Common Pitfalls There's no shortage of small missteps that can derail your case. Missing deadlines, incomplete paperwork, or even providing the wrong type of evidence can cause significant delays. And unfortunately, the immigration system doesn't bend the rules just because you're unfamiliar with the process. Something as simple as forgetting to include a specific document because you didn't realize it was needed can backlog your case by months. One common misconception we see is the idea that a single mistake is easily fixable. Sadly, that's not... --- > Vrapi Weeks is hiring a bilingual attorney in Santa Fe or Albuquerque to make a difference in immigration law. - Published: 2025-02-05 - Modified: 2025-11-01 - URL: https://vrapiweeks.com/bilingualattorneyposting/ We are hiring a bilingual attorney to work in either our Santa Fe, NM, or Albuquerque, NM office! Employers who wish to sponsor employees for H-1B petitions should start to prepare their applications now to be ready for the lottery in March of 2025. The H-1B visa allows foreign nationals working in specialty occupations to seek employment in the USA for a three-year period. There are 65,000 H-1Bs available each year for foreign nationals with bachelor’s degrees and an additional 20,000 available for foreign nationals who received their master’s degree in the U. S. However, the demand for H-1Bs is higher than 85,000 and so USCIS runs a lottery each year to determine who may file an H-1B petition. In recent years, there has been about a 25%-31% chance of success in the H-1B lottery. For many employers, the lottery will be the only opportunity during 2025 to apply for an H 1B visa. First Step: Registration The first step in the H-1B cap process is filing a lottery registration online with USCIS. Registration involves submitting basic information about the employer and employee. Registration dates have not yet been announced but are typically open from early March until mid-March. Second Step: H-1B Lottery Selection After the close of the registration period, USCIS runs a random lottery and notifies those who are selected. Last year, the lottery winners were notified electronically by April 1st. Typically USCIS selects more than 85,000 registrants with the understanding that not all registrants will ultimately submit H-1B petitions. Those not selected are put on a waiting... --- > Find out the latest updates, services, and news happening at the Albuquerque immigration law office of Vrapi Weeks. - Published: 2024-11-16 - Modified: 2025-11-01 - URL: https://vrapiweeks.com/what-is-happening-in-the-albuquerque-office-of-vrapi-weeks/ Our Albuquerque immigration lawyers focus on breaking immigration barriers for families and businesses so they can focus on what’s important. S. consulate can be quite mystifying! This blog will teach you how to find your priority date and how to determine if it is “current” or not. First, let’s review some terminology. Visa Bulletin: The Department of State issues a notice each month, which dictates who may apply for a green card either by filing an I-485 Adjustment of Status application or by applying for an immigrant visa at a U. S. consulate in that given month. This notice is called the “Visa Bulletin” and is found here. The visa bulletin exists because the U. S. government can only give out a certain number of green cards each year and there are many rules about how those green cards can be allocated. The visa bulletin tells you when it is your turn to apply for a green card. Employers who wish to sponsor employees for H-1B petitions should start to prepare their applications now to be ready for the lottery in March of 2024. In recent years, there has been about a 25% chance of success in the H-1B lottery. For many employers, the lottery will be the only opportunity during 2024 to apply for an H‑1B visa. First Step: Registration The first step in the H-1B cap process is filing a lottery registration online with USCIS. Registration involves submitting basic information about the employer and employee. USCIS has not yet announced the registration period for FY2025, but usually it is during the first few weeks of March. Second Step: Lottery Selection After the close of the registration period, USCIS runs a random lottery and notifies those who are selected. Last year, the lottery winners were notified electronically by April 1st. Typically USCIS selects more than 85,000 registrants with the understanding that not all registrants will ultimately submit H-1B petitions. S. immigration system is by and large a “pull” system, where there has to be a U. S. based petitioner (be it a family member or an employer) that asks the government to allow a foreign national to obtain permanent residence in the US. This is in contrast to a “push” system like Canada’s, where one can apply to move there without having anyone from inside the country pulling them in. The U. S. “pull” system makes the permanent residency process a two-part process. The first part is the U. S. petitioner’s request to the government to accord immigrant status to a foreign national. The second part is the foreign national’s application for permanent residence in the form of an application for adjustment of status for those in the U. S. or in the form of an application for an immigrant visa at a U. S. consulate for those who are abroad. Some immigrants are considered “immediate relatives of U. S. citizens” where there is no wait list for visas. If an immigrant is the spouse of a U. S. citizen, an unmarried child under 21 years old of a U. S. citizen, or a parent of a U. S. citizen child over 21 years of age, there is no wait list for a visa. S. In the vast majority of cases this is done through the J-1 visa. The J-1 visa requires that the physician return to their home country for 2 years following their training before the physician can apply for an H-1B visa or permanent residence in the US. The majority of physicians in J-1 status apply for special physician waivers to this 2-year home residence requirement which require the physician to serve for 3 years in a medically underserved area in the United States. The PERM-Based Path to Permanent Residence The most common path for foreign born physicians to gain permanent residence in the United States is the PERM labor certification process. This is the generic process that is followed by most other professionals as well. It consists of 3 steps: 1. The PERM Labor certification process; 2. The I-140 immigrant visa petition; and 3. The adjustment of status application. The PERM process has 3 sub-steps: a. prevailing wage determination which is currently taking 6-11 months; b. recruitment which usually takes 2 months; and, c. the PERM application which is currently taking 6-12 months. The PERM and the I-140 can be filed during the 3-year waiver commitment described above. However, the third part of the process, which is the actual application for permanent residence cannot be filed until the 3-year waiver commitment ends. This is in contrast to a “push” system like the one in Canada. In the push system, a foreign national can apply to move there without having an employer or family member inside the country pulling them in. The U. S. “pull” system for employment-based visas makes permanent residency a two-step process. The first step is the U. It's in the form of an application for a change of status for those in the U. S. or an application for an immigrant visa at a U. S. consulate for those abroad. What Factors Limit Employment-Based Visas? Congress has limited the number of visas (green cards) issued annually. This becomes a supply and demand system that creates backlogs depending on the demand for the limited supply of employment-based visas. The more demand there is, the bigger the backlogs grow. Another layer of complication is that Congress also put a per-country cap for employment-based visas. This means that for each category, those born in a certain country cannot make up more than 7% of that pool of visas. They can remain in the United States so long as their status is good and even change or extend beyond that without needing a visa stamp. Once a live person answers, explain the need to expedite your case based on being a healthcare worker and that either your application has been pending for more than 90 days, or your current EAD will expire in less than 30 days, and a renewal is pending. You will need your pending I-765 EAD application receipt number for either scenario, so have that handy. S. government interests; Clear USCIS error. If you believe your case falls under one of the grounds above, the steps to request an expedite are as follows: Call USCIS at 1 (800) 375-5283. Say the magic words "Make an InfoPass appointment" (and keep repeating them) to get through to a live person. Once a live person answers, explain the need to expedite your case based on one of the grounds above. You will need your pending case application receipt number, so have that handy. After a certain amount of time (usually a day or two), USCIS will email you requesting that you send documentation to support your claim. Once you receive the email and you have the documentation ready here is how you submit it to USCIS.... --- > At Vrapi Weeks, our Roswell immigration lawyer discusses remote work challenges for H-1B employers. - Published: 2023-03-24 - Modified: 2025-11-01 - URL: https://vrapiweeks.com/remote-work-issues-for-h-1b-employers/ The U. S. immigration system is pretty antiquated, so new developments like the emergence of widespread remote work creates issues that can be insurmountable at times for H-1B employers and employees. This post will not cover all the possible problems that remote work brings; it will only focus on wage and worksite issues. H-1B petitions are employer-specific, employee-specific, position-specific, and worksite-specific. If any of the above four things changes, a new petition must be filed. The first two are evident; if there is a change of employer or employee, the H-1B is no longer valid. The last two are less "in-your-face" obvious and get missed a lot. This creates problems since if an amended petition is not filed before the change occurs, it is considered a status violation. Let's focus on the last one: worksite changes. Before the pandemic, this was a rare occurrence. When most everyone worked at an employer's physical location, worksite changes typically occurred when the employer changed locations. This was a planned event, and amended petitions were done on a timely basis. However, with the emergence of work-from-home (WFH), the worksite has become much more mobile. This creates two problems. First, every time someone moves homes, it requires action on the part of the employer to ensure compliance and maintenance of status. Second, the new location may have a prevailing wage above what the employer pays. Let's look at each in turn. A WFH employee who moves within the same metropolitan statistical area (MSA) requires the... --- > Stay updated on the latest changes to religious worker immigrant visas and how they might affect your application with a Farmington work visa lawyer at Vrapi Weeks. - Published: 2023-03-23 - Modified: 2025-11-01 - URL: https://vrapiweeks.com/religious-worker-immigrant-visa-updates/ Religious workers may apply for green cards to work in the USA permanently by filing an I-360 petition, and then after the I-360 is approved, filing an I-485, Adjustment of Status petition or applying for an immigrant visa at the consulate if their I-360 priority date is current. The reason why the concept of a “priority date” exists is because the USA gives out a limited number of green cards each year for various immigration categories. Religious workers fall under the Employment-Based 4th Preference Category (EB-4), along with other types of immigrants such as Special Immigrant Juveniles (SIJ) who are children who were abused/abandoned. Only 10,000 EB-4 visas may be issued each year. When demand is higher than the number of available visas (10,000 per year), a backlog emerges. Filing an immigrant petition (such as the I-360) establishes a priority date, which puts the beneficiary “in line” for a green card under their visa category. In addition to the overall quota for the entire category, U. S. immigration law established a per-country limitation of 7%. This means that beneficiaries born in a particular country cannot receive more than 7% of the visas for that category, creating special backlogs based on country of birth. Up until March of 2023, the Department of State followed the per-country limitation, which meant that certain countries had to wait a few years for EB-4 green cards (e. g. Mexico, El Salvador, Guatemala, Honduras), while the rest of the world had to wait significantly less time... --- > Understand the rules for H-1B LCA retention to meet compliance requirements. The employer must also create a Public Access File (PAF) which contains the LCA and other documents that are supposed to be made available to the public on demand. The subject of this post is only the retention rules for these records. This post will not address other LCA or PAF issues. The PAF must be maintained by the employer either at the principal place of business (i. e. headquarters) or place of employment (the employer indicates the location of records in the LCA at filing) for the following periods: For a period of one year beyond the last date on which you employed any H-1B worker under the LCA, or If the employer did not employ any H-1B workers under the LCA, one year from the date the LCA expired or from the date it was withdrawn In light of the above, we recommend to our employer clients that as part of the PAF creation procedures, they institute a calendaring/reminder system where they enter a reminder to purge the PAF 1 year after the expiration date of the LCA. If the H-1B employee ends up being separated from employment before the expiration date of the LCA, the employer should reschedule the above reminder to 1 year beyond the date of separation. We recommend purging the PAF after the retention period expires. The employer must also retain payroll records... If someone is present in the United States without permission for more than 6 months and then leaves the United States, the person is ineligible to apply for green cards for 3 years unless they qualify for a waiver. If someone is present in the United States without permission for more than one year and then leaves the United States, they will not be eligible to apply for green cards for 10 years unless they qualify for a waiver. Now, they can apply for U. S. permanent residence without a waiver if they have a relative who can apply for them. The change does not fix all presence without permission issues. Contact our Albuquerque immigration lawyer at Vrapi Weeks. - Published: 2022-05-31 - Modified: 2025-11-01 - URL: https://vrapiweeks.com/renew-my-h-1b/ A frequent question we get from clients is whether they should renew their H-1B (or other nonimmigrant) status once their Employment Authorization Documents (EADs) are approved through a pending adjustment of status application. With very few exceptions, we always recommend renewing H-1B status. This is so for several reasons. Letting go of H-1B status while an adjustment of status application is pending places one in what is called "a period of authorized stay" (POSA). POSA is not status. In addition, the POSA is tied to the adjustment of status application. This is important because if the adjustment of status application is denied for any reason (including USCIS error or losing your job and your employer withdrawing the petition) POSA ends and the client has to leave the country immediately. It can be very disruptive to one's life and their employer's business activities. If one remains in H-1B status, even if the adjustment application is denied, the person can continue to live and work in the US while we resolve the adjustment issues or even refile. In addition, maintaining H-1B status can also facilitate short notice travel outside the US as H-1B status holders can leave the US without Advance Parole (AP) and not abandon their adjustment application. When an AP is expired and it is being renewed, one cannot leave the US until the AP is actually approved. Another reason to remain in H-1B status is the protections of INA 245(k), which forgives certain periods of unlawful presence or unauthorized... --- > Apply now to join Vrapi Weeks as a Legal Assistant/Paralegal in Albuquerque and help clients succeed in their immigration journeys. - Published: 2022-04-28 - Modified: 2025-11-01 - URL: https://vrapiweeks.com/legal-assistant-paralegal-in-albuquerque/ Apply on Indeed by clicking here. Talk to our Santa Fe immigration lawyers. - Published: 2022-01-21 - Modified: 2025-11-01 - URL: https://vrapiweeks.com/uscis-updated-policy/ Many aspiring immigrants have more than one immigrant visa petition filed on their behalf. This became a very common occurrence in 2020 when the cutoff dates for EB-3 category for India jumped up considerably and surpassed EB-2 cutoffs. As a result, many Indian nationals who had EB-2 I-140 petitions approved years ago, filed "downgrade" I-140 petitions under EB-3 so they could concurrently file for adjustment of status. EB-3 cutoffs being faster was short-lived as in recent months, things have gone back to the "old" days of EB-2 being faster than EB-3. This has created the need for "interfiling" the currently pending I-485 adjustment of status applications (that were filed with the "downgraded" EB-3 I-140 petitions) with the much earlier filed and approved EB-2 I-140 petitions. This is also called transferring the underlying basis. For many years USCIS did not have a specific procedure on how to accomplish this and for the most part it was never done correctly, forcing applicants to file a second adjustment of status application with the EB-2 I-140 to get it processed. USCIS updated its website today with instructions on accomplishing this interfiling request and a specific address to send these requests to. It remains to be seen whether this will be effective or whether it will like in the past where these requests never made it anywhere. Nevertheless, this is a good step in the right direction and a very welcome one. Contact Vrapi Weeks to begin. - Published: 2021-12-27 - Modified: 2025-11-01 - URL: https://vrapiweeks.com/waivers-of-the-interview/ The Department of State has announced that it has decided to waive the in-person interview requirement for the following nonimmigrant visas: H-1, H-3, H-4, L, O, P, Q, F, M, and academic J. Consular officers will have discretion to waive the interview if the applicant has been issued any type of visa in the past and have never been refused a visa unless the refusal has been overcome or waived. Even those who have never been issued a visa before can have their interview waived if they are a citizen of a country that participates in ESTA (visa waiver) and they have previously traveled to the US on ESTA. This is a big benefit to many nonimmigrants applying for visas in this pandemic world of almost non-existent appointment slots at consulates above, however, it is proving difficult for Indian applicants. Those applying at US consulates in India may be familiar with the drop box system there. However, the drop box system in India requires an appointment to drop off documents. These appointments have become very hard to come by, and with the new policy even clients who would like to get an interview since it's actually faster, are being told they need to go through the drop box route. We are warning all our clients to plan accordingly since traveling without having an appointment scheduled can result in significant delays. The US mission in India has announced that they are planning on adding 20,000 appointments to the drop box schedule,... --- > DACA Dreamers face upcoming changes that may impact their path forward. The fight is far from over. There is still hope for Dreamers. Here’s why: President Biden is appealing to higher courts and also working on a plan to reissue regulations for a stronger DACA program. Members of Congress are still fighting for immigration reform to create a path to citizenship for Dreamers and stop the uncertainty. What should you do? If you already have DACA status, you can continue to file renewals. The new judge’s order does not change that. If you have an open or pending DACA case, our advice is to wait and see. This Texas judge’s order to stop DACA is being challenged, and we hope that the processing of new DACA applications resumes shortly! As a permanent resident, you have permission to work and live indefinitely in the United States. Being a permanent resident can also lead to better work opportunities and can give you access to federal financial aid for your education. Finally, permanent residents can leave and re-enter the United States, allowing you to travel abroad to see family, go on vacation, or attend professional conferences. In general, it can take anywhere from six months to over a year to get a green card. The amount of time is based on three main factors: Completeness of application General processing times Specific Location Completeness of Application Filing for a green card is more complicated than just filling out a form. A typical green card application packet will include 5-8 different immigration forms totaling almost 90 pages. In addition, there can be over 100 pages of supporting documents that accompany the application, including certain biographic documents and financial records. Finally, there are specific rules for each form regarding when, where, and how to file it, including detailed instructions on how to pay the government filing fees. As your green card case is being processed, it is reviewed for completeness. If any part of the application is deemed incomplete, it may be rejected and sent back to you. He also extended the scope of the ban to include those coming into the United States in H-1B, H-2B, L-1, and certain J-1 categories. Who is affected? The executive order affects only those who are outside of the United States applying for visas. If the foreign national is in the United States, this EO does not appear to affect them. In other words, extensions of status, changes of employer, or even changes of status can be filed and approved. If the foreign national is abroad and will be applying for an H-1B visa, this EO prohibits their visa issuance and entry to the US. The EO does not appear to prohibit filing the H-1B petition, only visa issuance after the H-1B petition is approved. Therefore, employers should continue to file H-1B petitions even for employees abroad, especially for cap cases so as not to lose their cap selections, and then wait for visa issuance when the restrictions are lifted. Exceptions to this travel ban appear to be Canadian citizens. The EO prohibits entry for those who are coming with H-1B visas. Canadian citizens are visa-exempt, therefore, they are not entering with an H-1B visa. As a result, the EO does not cover them. Up until 2013, if a family member was petitioning someone for permanent residence but could not complete that process from within the United States, the person had to depart and apply at a U. S. consulate abroad. Because of a law passed in 1996, anyone who departs the United States after having been here for more than 180 days or 1 year without status triggers a 3 or 10 year bar, respectively. Therefore, that family member who departed to apply at the consulate would need to file a waiver to be able to return before the 3 or 10 years. This waiver took several months to be approved, so families were separated for months and sometimes over a year while the paperwork was being processed since the foreign national had to wait outside the United States. In 2013, DHS began allowing spouses of U. S. citizens to apply for the waiver while still in the United States. This made a huge difference for two reasons: 1. The wait of the foreign national relative abroad would be very short (1-2 weeks as opposed to months or years), and 2. the foreign national left with an approval in hand as opposed to going to apply for something, which also gives one great peace of mind. However, the 2013 rule was only limited to certain classes of people,... --- > Celebrate Olsi Vrapi being honored as Young Lawyer of the Year for his outstanding contributions to immigration law in Albuquerque. - Published: 2016-06-14 - Modified: 2025-11-01 - URL: https://vrapiweeks.com/young-lawyer-of-the-year/ The American Immigration Lawyers Association (AILA) awarded Olsi Vrapi the 2012 Joseph Minsky Young Lawyer Award for his outstanding contributions in the field of immigration and nationality law.
