USCIS has a formal process in place for certain cases meriting expedited processing.  Expedited processing means that you are requesting that USCIS adjudicate your case faster than their normal processing times.

Expedite processing is considered for the following scenarios:

  • Severe financial loss to a company or person
  • Emergencies and urgent humanitarian reasons;
  • Nonprofit organization (as designated by the Internal Revenue Service) whose request is in furtherance of the cultural or social interests of the United States;
  • U.S. government interests;
  • Clear USCIS error.

If you believe your case falls under one of the grounds above, the steps to request an expedite are as follows:

  • Call USCIS at 1 (800) 375-5283. Say the magic words “Make an InfoPass appointment” (and keep repeating them) to get through to a live person. Once a live person answers, explain the need to expedite your case based on one of the grounds above. You will need your pending case application receipt number  so have that handy.
  • After a certain amount of time (usually a day or two) USCIS will email you requesting that you send documentation by fax to support your claim.
  • After submission of the above, USCIS will make a decision on whether to expedite your case or not and inform you via email.

If, on the other hand, you are not requesting that USCIS adjudicate the case faster than usual, but your case is unreasonably delayed, there are other options such as a congressional inquiry or even suing the government.  If your case is unreasonably delayed and you would like to file suit against the government to adjudicate your case promptly, please let us know.
